What is the UK tenancy deposit cap?

Under the Tenant Fees Act 2019, deposits are capped at 5 weeks rent for tenancies with annual rent under £50,000, and 6 weeks rent for tenancies with annual rent of £50,000 or more.

What happens if I take more than 5 weeks deposit?

The tenancy is unlawful and you cannot serve a valid Section 21 notice until the excess is returned. The tenant can claim back the full excess plus interest.
